1. Acceptance of Terms and Parties
These Terms of Service (hereinafter referred to as "Terms") govern your use of Miramo (hereinafter referred to as "the App") provided by Akira Kawata (hereinafter referred to as "Operator"). By downloading and using the App, you agree to these Terms.
You acknowledge that these Terms are concluded between you (hereinafter referred to as "End-User") and Operator, and not with Apple Inc. (hereinafter referred to as "Apple"), and that Operator is solely responsible for the App and its content, and Apple has no obligation whatsoever under these Terms.
2. License
The App is provided as a non-exclusive, non-transferable license for use on Apple-branded products (iPhone, iPad, etc.) that End-User owns or controls. You have the right to use the App under the following conditions:
- Use the App for personal use purposes only
- Do not modify, reverse assemble, or reverse engineer the App
- Do not sell or redistribute the App to third parties
- However, if you purchased the App, you may use the App on other accounts associated with Family Sharing or volume purchasing
3. Maintenance and Support
Operator shall be solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms, or as required under applicable law. You and End-User acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. Warranty
You, as End-User, are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, End-User may notify Apple, and Apple will refund the purchase price for the App to End-User; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
5. Product Claims
You and End-User acknowledge that you, not Apple, are responsible for addressing any claims of End-User or any third party relating to the App or the End-User's possession and/or use of that App.
Such claims include, but are not limited to: product liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.
These Terms may not limit your liability to End-User beyond what is permitted by applicable law.
6. Intellectual Property
All intellectual property rights to content included in the App (text, design, logos, program code, etc.) belong to Operator or legitimate rights holders.
In the event of any third party claim that the App or End-User's possession or use of the App infringes that third party's intellectual property rights, you (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
End-User represents and warrants that:
- End-User is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- End-User is not listed on any U.S. Government list of prohibited or restricted parties

9. Third Party Services
The App may use third-party services such as Google Analytics 4 (GA4) and AdMob in the future. When using these third-party services, you must comply with each third party's terms of use and privacy policy.
10. User Obligations
You agree to the following obligations:
- Provide accurate information to the App
- Manage entered information at your own responsibility
- Use the App in a manner that complies with laws and public order and morality
11. Prohibited Acts
You must not engage in the following acts:
- Acts that violate laws or public order and morality
- Acts that defame or slander others
- Acts that infringe on copyright or other intellectual property rights
- Acts that interfere with or improperly use the App's functions
- Any other acts that violate these Terms
If prohibited acts are discovered, Operator has the right to suspend provision of the App to you without prior notice.
12. Disclaimer
The App is provided "AS IS". The Operator does not guarantee:
- The functionality or quality of the App
- That the App is suitable for any particular purpose
- That bugs or issues in the App will be fixed
13. Limitation of Liability
Except for damages caused by Operator's intentional misconduct or gross negligence, Operator shall not be liable for any damages (including direct, indirect, or lost profits) related to the use of the App.
However, considering the Consumer Contract Act, the maximum limit of damages for which Operator is liable shall be the total amount of usage fees you have paid to the App in the past 3 months (or 1,000 JPY if that amount is less than 1,000 JPY).
14. Apple as Third Party Beneficiary
You acknowledge and agree that Apple and its subsidiaries are third party beneficiaries of these Terms, and that upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Japan and international treaties. Tokyo District Court shall be the exclusive court of first instance for all disputes related to the App.
16. Changes to Terms
The Operator reserves the right to modify these Terms as necessary. We will notify you of changes by updating the App or website. Continued use of the App after changes constitutes acceptance of the updated Terms. Please check the latest Terms regularly.
